1. Acceptance of Terms
Welcome to Tanyalah. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and VSG Labs Sdn Bhd, a company incorporated under the laws of Malaysia ("Company", "we", "us", or "our"), governing your access to and use of the website located at tanyalah.com (the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.
2. Description of Service
Tanyalah is a web-based anonymous messaging platform that allows users to create personal links through which others can send them anonymous messages. The Service enables users to receive candid feedback, questions, compliments, and other forms of communication from anyone who has access to their unique link, without revealing the sender's identity.
The Service is currently provided exclusively as a web application. The Service is provided free of charge, with no in-app purchases or premium tiers. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
3. User Accounts
Eligibility. You must be at least thirteen (13) years of age to create an account and use the Service. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts that we reasonably believe are operated by users under the age of 13.
Registration. To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.
Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] if you become aware of any unauthorised use of your account or any other breach of security. We shall not be liable for any loss or damage arising from your failure to protect your account credentials.
4. User Content
Ownership. You retain all ownership rights in the content you submit, post, or display on or through the Service ("User Content"). We do not claim ownership over any User Content.
Licence Grant. By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, distribute, display, and perform your User Content solely in connection with operating and providing the Service. This licence terminates when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it.
User Responsibilities. You are solely responsible for all User Content that you submit through the Service. You represent and warrant that you have all rights necessary to submit such content and that your content does not violate any applicable law, regulation, or the rights of any third party.
5. Prohibited Conduct
You agree not to use the Service to:
- Harass or bully — Send messages intended to intimidate, demean, or cause emotional distress to any individual.
- Threaten violence — Make threats of physical harm, self-harm, or any form of violence against any person or group.
- Promote hate speech — Post content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Spam — Send unsolicited, repetitive, or bulk messages, or use automated means to send messages through the Service.
- Impersonate others — Falsely represent yourself as another person, entity, or organisation, or create accounts intended to mislead others about your identity.
- Share illegal content — Distribute content that violates any applicable local, state, national, or international law, including but not limited to content relating to child sexual exploitation, non-consensual intimate imagery, or illegal substances.
- Distribute malware — Upload, transmit, or distribute viruses, malware, spyware, or any other malicious code or software through the Service.
- Circumvent security measures — Attempt to bypass, disable, or interfere with any security features of the Service.
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending or terminating accounts, and reporting the conduct to law enforcement authorities where appropriate.
6. Content Moderation
We reserve the right, but are not obligated, to review, monitor, and remove User Content at our sole discretion and at any time, without prior notice. We may remove any content that we reasonably believe violates these Terms, is harmful, objectionable, or otherwise inappropriate.
Reporting. If you encounter content that you believe violates these Terms or is otherwise harmful, you may report it using the reporting mechanism provided within the Service, or by contacting us directly at [email protected]. We will review reports in good faith and take action where we deem it appropriate. However, we are not obligated to take any specific action in response to a report.
We do not guarantee that all objectionable content will be identified or removed. You acknowledge that by using the Service, you may be exposed to content that you find offensive or objectionable, and you use the Service at your own risk in this regard.
7. Intellectual Property
The Service, including its original content (excluding User Content), features, functionality, design, logos, trademarks, and service marks, is and shall remain the exclusive property of VSG Labs Sdn Bhd and its licensors. The Tanyalah name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of VSG Labs Sdn Bhd. You must not use such marks without our prior written permission.
Nothing in these Terms grants you any right to use any of our trademarks, logos, domain names, or other distinctive brand features without our express written consent.
8. Third-Party Links
The Service may contain links to third-party websites, services, or resources that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
VSG Labs Sdn Bhd, its subsidiaries, affiliates, and licensors do not warrant that (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VSG LABS SDN BHD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (c) ANY CONTENT OBTAINED FROM THE SERVICE; OR (d) UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
In jurisdictions where limitations on liability for consequential or incidental damages are not permitted, our liability shall be limited to the maximum extent permitted by law. In no event shall our total aggregate liability exceed Ringgit Malaysia One Hundred (RM 100.00).
11. Indemnification
You agree to defend, indemnify, and hold harmless VSG Labs Sdn Bhd, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to legal fees) arising from: (a) your use of and access to the Service; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any claim that your User Content caused damage to a third party. This indemnification obligation shall survive the termination of these Terms and your use of the Service.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of laws principles. Any reference to applicable data protection legislation shall include the Personal Data Protection Act 2010 (Act 709) of Malaysia and any amendments thereto.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be submitted to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia. You irrevocably consent to the jurisdiction and venue of such courts and waive any objection based on inconvenient forum.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least thirty (30) days' notice prior to any new terms taking effect, such as by posting a notice on the Service or by sending a notification to registered users. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any modification or deletion of a provision under this section shall not affect the validity and enforceability of the remaining provisions of these Terms.
